Frequently asked questions
How will my legal costs be paid for?
We will look into the options available for funding the cost of your case at the beginning of your claim. Where we are able to accept a claim, we will offer to represent you under the terms of a no win no fee agreement unless you have a better option open to you, such as existing insurance cover.*
Will my claim be handled by a specialist?
All of our clients who have suffered a serious head injury are looked after by a legally qualified person who has experience and training specifically in dealing with legal claims after head injury. Often, we work as a team to ensure the best results for our clients so that we can offer a broad range of skills.
Will I see my solicitor?
When we represent a client with serious head injuries, we make it our business to get to know you and meet with you face to face to review your claim. We will also keep in touch with you and update you by phone, letter or email as and when, to keep you informed of progress.
Do you cover the whole country?
In short, yes. We have offices throughout Great Britain and provide a service to you wherever you live within GB- so don’t worry if you live away from one of our office bases.
How long will my claim take?
We will discuss this with you at outset and review it with you as your case progresses. We aim to get you a final result within a timescale that is right for you, however it is often the case after a serious head injury that time is needed to ensure that you can complete your rehabilitation and adjust to life after head injury: settling a claim too early can have negative consequences in the long term.
What about interim payments?
Because a case can take time to resolve, we will actively look to secure upfront payments of damages wherever possible, especially if you have need for the funds. This can generally be done where there is an insurer who has accepted fault and we can prove financial losses on your part. Often interim payments can be used to help with finances and to purchase private support and therapy to help the recovery process.
How does it all work and what will I have to do?
The process involves gathering factual information about how you were injured, your treatment and your financial losses. We will firstly need to establish that your injury was someone else’s fault, to prove the right to compensation. We will consider your rehabilitation needs then arrange for experts to assess your injuries and the long term outlook. We will need to gather evidence of any loss of earnings, out of pocket expenses and care needs to present as part of the claim. Your case will either be resolved by negotiation to agree a compensation amount, or by the court deciding at a hearing.

* We are not able to offer no win no fee arrangements for clients pursuing claims in Scotland or certain other jurisdictions. We can advise on the options for funding those cases depending upon the circumstances.
** Except in claims pursued through the Criminal Injury compensation scheme and the Motor Insurer’s Bureau Untraced Driver Scheme, where legal costs are not normally awarded to successful claimants. In those cases, we will let you know of any charges in writing so that you know what to expect.
