Head & Brain Injury Costs

If you are thinking of making a claim for head or brain injury compensation, it is understandable that you will need reassurance about how the legal costs involved and how your injury claim will be funded. You want to be confident that making a head or brain injury claim will not leave you with a big bill at the end of it.

After a major life changing injury, you will have enough to think about without the distraction of worrying about legal costs. At The Head Injury Site we will always clearly explain the options and offer the best funding arrangement for you.

Our promise to you

In the vast majority of cases, we are happy to work for you under a no win no fee agreement, subject to the terms of that agreement. This will mean:-

  • FREE initial investigation of your potential claim
  • If we then can accept your claim, we offer you a No Win No Fee agreement*
  • Free funding of expenses which have to be paid during your case
  • We will work for you on a no win no fee basis.

There are a small number of cases where we may not be able to offer all of these terms, usually cases involving criminal injury claims or claims against untraced drivers. However we will always even in those cases offer you a No Win No Fee agreement if we can accept your case.

All Scottish cases will be handled by the Scottish law firm with which we are associated, Irwin Mitchell Scotland LLP. The law relating to funding is different in Scotland and you will receive separate advice about what that means as well as a separate funding agreement.

Are there any other options?

There may be several options for funding a legal claim.

  • You may have the benefit of an insurance policy that provides help with legal costs (such as your household insurance or with a credit card).
  • You may be a member of a Trade Union which offers members benefits including legal help.

However, these options may come with limits and conditions attached, and you may not be free to choose a specialist brain injury lawyer who can expertly represent you in your claim.

There are some limited situations in which we can help you apply for help with legal costs through the Legal Services Board (formerly "legal aid") - but this is usually only for certain types of claims such as injuries arising from clinical negligence.
