Sunderland Man Awarded Compensation Following Criminal Assault

Our client, Andrew, has been awarded the maximum amount of compensation under the Criminal Injuries Compensation Scheme after he suffered a brain injury as a result of an unprovoked attack.

Andrew, who was a British Army medic at the time, was attacked while leaving a pub. He suffered brain damage and has been unable to work since the incident.

Andrew applied for compensation under the Criminal Injuries Compensation Scheme but it was ruled that he had provoked the attack and was therefore not eligible for an award under the scheme.

Andrew then contacted Irwin Mitchell Solicitors who appealed the decision. Lindsey Houghton handled Andrew’s case and took his claim to the Criminal Injuries Compensation Appeals Panel.

The panel decided that compensation should be paid on a 50% basis, but Lindsey successfully argued that he should receive the maximum award available under the scheme (£500,000).

Lindsey Houghton said, “I am pleased that I could help Andrew secure the maximum award possible under the CICA scheme. I am saddened however that he has had to fight to obtain the compensation he deserves, despite suffering life changing injuries.  I believe that changes are required to the way victims of crime are treated in the UK.”
